Terms and Conditions 


1. Introduction and Acceptance of Terms

  • Agreement: Clearly state that by accessing or using the "Bettowon Skills Space" LMS (the "Service"), the User agrees to be bound by these Terms and Conditions ("Terms").

  • Age Restriction: State the minimum age for users (e.g., 18, or require parental consent for minors).

  • Effective Date: Specify when the current version of the Terms becomes effective.


2. Services and Access

  • Description: Define what "The Service" is (the LMS platform, including course delivery, tracking, and all associated tools).

  • Modification: State that you reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

  • Availability: Include a disclaimer that the Service is not guaranteed to be uninterrupted or error-free and that you are not liable for periods of downtime.


3. User Accounts and Security

  • Registration Data: Users must provide accurate, current, and complete registration information.

  • Confidentiality: Users are solely responsible for maintaining the confidentiality of their passwords and for all activities under their account.

  • Prohibited Sharing: Explicitly prohibit the sharing of login credentials. Sharing credentials is a common violation in LMS terms.

  • Termination: Reserve the right to terminate or suspend accounts immediately for any violation of these Terms (e.g., sharing accounts, unauthorized content use).


4. Fees, Payment, and Refunds

  • Pricing: State that all fees are subject to change and that you will notify users of changes.

  • Payment: Describe accepted payment methods and billing cycles (e.g., monthly, annual subscription).

  • Refund Policy: This must be clear. State whether course purchases or subscriptions are refundable, and if so, under what specific conditions (e.g., full refund within 7 days if less than 10% of the course is completed).


5. Intellectual Property Rights (The most critical section for an LMS)

  • Platform Ownership: State that Bettowon Skills Space owns all rights, title, and interest in the LMS platform, software, and underlying technology.

  • Course Content Ownership:

    • State that the Instructors/Content Creators retain ownership of their course materials.

    • State that Bettowon Skills Space is granted a necessary license to host, display, and distribute the content on the platform.

  • User License: Grant the User a limited, non-exclusive, non-transferable license to view and use the Course Content for their personal, non-commercial educational purposes only.

  • Prohibitions (Strict): Prohibit the copying, reproduction, distribution, public display, reverse engineering, recording, sharing, or creating derivative works of the Course Content or the Platform without explicit written permission.


6. Acceptable Use Policy (Code of Conduct)

Users must agree not to:

  • Use the Service for any illegal or fraudulent purpose.

  • Upload or transmit harmful code, viruses, or disruptive files.

  • Harass, abuse, or post defamatory or discriminatory material.

  • Interfere with the security or operation of the Service.


7. Limitation of Liability and Disclaimer of Warranties

  • "As Is" Service: State that the Service is provided "as is" and "as available," without warranties of any kind.

  • Content Accuracy: Disclaimer that you do not guarantee the accuracy, completeness, or usefulness of the Course Content provided by third-party Instructors.

  • Limitation: Limit your financial liability to the fullest extent permitted by law (e.g., typically limited to the amount paid by the user in the last six or twelve months).


8. Governing Law and Dispute Resolution

  • Jurisdiction: Specify the laws that will govern the Terms (e.g., "The laws of [Your Country/State]").

  • Dispute Resolution: Outline the process for resolving disputes (e.g., Mandatory Arbitration or only through courts in a specific city/state).


9. Privacy

  • Integration: Include a clause requiring users to read and agree to your separate Privacy Policy, and include a direct link to that policy.
